  PREPARATIONS FOR 2007 NATIONAL ELECTIONS (Important info on OAV) 
Government and PoliticsOn behalf of the Commission's Committee on Overseas Absentee Voting (COAV), I would like to welcome you to the OAV (Overseas Absentee Voting) link of this website.

February 2003 saw the passage of the Overseas Absentee Voting Law (OAVL) giving life and meaning to the Constitutional mandate that our countrymen abroad be given their right of suffrage even if away from home.

Hence, the first registration of overseas absentee voters was conducted during the months of August and September of 2003 for them to be able to cast their votes in the 2004 National Elections.

Just like births, the first OAV exercise was not without pains. But like a child growing up, we know that one day, the overseas absentee votes would make a difference in the whole Philippine electoral exercise.

With the extra mileage brought by cyber technology, we hope that the next registration period which shall commence on October 1, 2005 until August 31, 2006 would generate more registrants, hence, greater participation of overseas Filipinos in future elections.

PROPOSED AMENDMENT (http://www.comelec.gov.ph/oav/2ra9189s5.html RA 9189, Sec. 5)

Sec. 5. Disqualifications. - The following shall be disqualified from voting under this Act:
a. x x x; This is in recognition of R.A. 9225 (http://www.comelec.gov.ph/oav/oav_ra9225.html) which restores all political and civil rights to former Filipino citizens.
b. Those who have expressly renounced their Philippine citizenship and who have pledged allegiance to a foreign country; except those who have applied to reacquire or retain their Philippine citizenship under R.A. 9225 (http://www.comelec.gov.ph/oav/oav_ra9225.html),  otherwise known as the "Citizenship Retention and Reacquisition Act of 2003", where their applications have been approved by the Posts or the Bureau of Immigration and whose applications for registration as an overseas absentee voters has been approved by the RERB shall be allowed to exercise their right of suffrage; and,
c. x x x. To encourage more immigrants to register, the proposal is to do away with the Affidavit of Intent to Return.

PROPOSED AMENDMENT (RA 9189, Sec. 6 - http://www.comelec.gov.ph/oav/2ra9189s6.html)

Section 6. Personal Overseas Absentee Registration. - Registration and certification as an overseas absentee voter shall be done in person at the Posts that have jurisdiction over the locality where the applicant temporarily resides.

The applicant may download the Application for Registration/Certification Form from the websites of the Commission, the Department of Foreign Affairs through its Overseas Absentee Voting Secretariat (DFA-OAVS) and the Posts. The applicant may submit via mail, fax or e-mail his application form together with a photocopy of his Philippine passport or such other document/s sufficient to support his application for registration to the Posts where he intends to vote provided that not later than two hundred eighty (280) days before the next national elections, the applicant shall personally appear at the Posts where they mailed, faxed or e-mailed their applications for the capturing of his biometrics.

In the case of seafarers, they can personally appear at any Post where the vessel is docked to register indicating in their
application forms where they want their ballots are to be sent not later than two hundred eighty (280) days before the next national elections.

The Posts shall photocopy or scan or print all accomplished application for registration. The demographic data shall be encoded and pre-processed at the Posts using a system provided by the Commission. The soft copies containing the demographics and biometrics of the registrants together with the corresponding scanned/facsimile of the registration forms shall be sent to the Commission on a weekly basis from the start of the registration period with a formal report of the number of applications received for the week. The original copies of the application forms shall be kept at the Posts for reference purposes.

Upon the requests of the Posts and favorable recommendation of the DFA, field registration may be allowed by the Commission considering the number of potential registrants residing outside the perimeters of the foreign service establishments.

Subject to the specific guidelines herein provided, the Commission is hereby authorized to prescribe innovative and additional procedures for overseas absentee registration and adopt such other advanced technological system aside from the system being used by the Commission in the local registration, taking into strict consideration the time zones of the countries and the various periods and processes herein provided for the proper implementation of this Act and the other peculiarities attendant to the implementation of the overseas absentee voting.

Although registration shall still require personal appearance by the applicant, registration shall not be limited at the Posts. Mobile and field registration shall be strongly encouraged.

Owing to the mobile nature of seafarers, they are now allowed to register at any Post where they would be docking.

To avoid encoding problems resulting to misspelling in IDs, disapproved applications, the fields in the application form shall be encoded by the Posts.

NOTICE OF REGISTRATION AND ELECTION

Mga Kababayan:

The Philippine Embassy in Singapore announces the resumption of the system of continuing registration of all qualified Filipino citizens abroad pursuant to Section 7 of Republic Act 9189 (The Overseas Absentee Voting Act of 2003) and amending pertinent provisions of COMELEC Resolution No. 6117.

All applications for registration/certification as overseas absentee voter and the application to vote in absentia shall be filed from 1 October 2005 up to 31 August 2006, Sundays to Thursdays from 9:00-12:00 a.m. and 1:00-5:00 p.m. at the Philippine Embassy in Singapore, 20 Nassim Road, Singapore 258395.

Applicants are required to submit (1) a valid Philippine passport; (2) Work Permit, Employment Pass or Permanent Residence Card; and, (3) duly-accomplished OAVF No. 1. Seafarers are also requested to submit a photocopy of his Seaman's Book or any document that will prove that he is a seafarer. In cases of applicants who availed of Republic Act 9225 (The Citizenship Retention and Reacquisition Act of 2003), the original or certified true copy of the Order of Approval of his application to retain or reacquire his Filipino citizenship issued by the Post or the Bureau of Immigration.

The following may not register:

a. Those who have espressly renounced their Philippine citizenship and who pledged allegiance to a foreign country except those who have reacquired or retained their Philippine citizenship under R.A. 925;

b. An immigrant or a permanent resident who is reconized as such in the host country, unless he executes upon filing of application for registration as overseas absentee voter, an affidavit declaring that:

- he shall resume actual physical permanent residence in the Philippines pursuant to Section 5 of R.A. 9189; and

- he has not applied for citizenship in another country.
